Contract for Purchase of Goods

The terms " Ruski Way Deli & Cafe ", "We", "Us" or "Our" refer to Ruski Way Deli & Cafe, ABN 60161947833 whose registered trading premise is at 12A Tottenham St, Woolloongabba, 4102, QLD, Australia. All purchases made on this website are governed by the following Terms and Conditions; however, these Terms and Conditions are subject to change at any time. If any purchase is made after we have published changes to these Terms and Conditions, you will be bound by those changes in effect at the time of purchase. You should check these Terms and Conditions prior to each purchase to ensure that you understand the precise obligations of each party.

Confirmation of acceptance of your purchase will be made by a message immediately after we accept your order during the online checkout. We will send a confirmation email to your regestered email address (email address that you provided at the time of purchasing) that your order has been accepted. When acceptance has been made after checkout, you are explicitly agreeing to a contract for the purchase of goods. Under this contract, we will supply the goods to you in accordance with your order subject to these Terms and Conditions. Since all offers posted on this site are offers to treat, we have the right to reject acceptance even after the automated message and email response has been sent. In the event we do not accept your order, payment will be fully refunded.

 

Availability and Description of Products

While every care has been taken to ensure the descriptions and images displayed on our website are correct, food products are constantly being reformulated and ingredients and nutrition content may change. If you have an allergy or specific dietary requirement you should always check the label of food before consuming it. We accept no liability for the information presented in the descriptions regarding the ingredients of the product. Before consuming any product you should always read the labelling.

Manufactures often alter packaging and even quantity. Due to this fact you may, in rare circumstances, receive a product that does not appear the same as it did in its picture presented on the website. It is a common thing and we are unable of honouring any claims in regards to the above.

Stock levels displayed on our website are regularly updated, however, we will not be held responsible if any product is unavailable at the time of purchase. Because we trade both over the counter and through the internet an item that is displayed as being available online might have actually been sold over the counter. If such a situation occurs and a product your've purchased online is unavailable, we will:

  • replace the product with as similar one as possible of equal or higher value at our ful discretion, or

Price and Shipping Costs

Prices quoted on our website are in Australian dollars (AUD) and include all applicable taxes such as GST.

All prices listed on our website are subject to change at any time. The cost of goods is displayed on the website. Prices quoted do not include shipping costs. Shipping cost is calculated separately and added to the total order on the check out page. Shipping costs are specified during checkout and subject to change at any time without prior notice.

Shipping costs include freight charges, packing material, labels, handling, refregiration if required etc.

 

Payments

The site accepts payments via credit cards using a secure CommWeb Virtual Payment System. We accept Master Card and Visa for the payment through our website.

The payment can also be made via a third party payment gateway - PayPal - using balance in the PayPal account or by credit/debit card. A PayPal account is required to make payments via PayPal. Please refer to PayPal website for more details - www.paypal.com.au.

Your credit/debit card will be charged in real time once check out page for your order is completed. We do not store your credit/debit card details for processing.

 

Shipping Details and Delivery Information

By placing an order and paying for perishable goods on www.ruskiwaydeli.com.au you are providing us with the authority to leave the goods at the location specified by you during the checkout process.

If no instruction was left it will be up to the courier. We strongly recommend you provide alternative delivery instructions such as “leave at rear of house or with our next-door neighbour”.

When you place an order through our website online it is your responsibility to ensure that the details that you have provided are true and correct. If it turns out that the details are incorrect and the goods are delivered to the wrong address we cannot be held responsible. You will be charged the full amount including delivery costs plus any extra charges required to redeliver goods to your actual address.

When you place an order for perishable goods you are providing us with the authority to leave the goods at the location specified by you during the checkout process. That means when your order includes at least one perishable item your parcel will be left at your door regardless if you provide authority to leave or not.

By placing an order for perishable goods on our website you understand and accept that perishable goods require immediate unpacking and refrigerating on arrival. You also understand and accept that a parcel with perishables cannot be left at a courier depot or any other place overnight/day so it wil be delivered to and left at your door. It is your responsibility to organise for perishable items to be dealt with on arrival.

We cannot be held responsible for the goods once they have been shipped.

All orders are processed, packed and shipped once per week on Tuesday.

Your order will be shipped Tuesday following your order. Cut off time for shipping is 9am Monday. This means if you place and pay for your order before 9am on Monday your order will be shipped coming Tuesday otherwise it will be packed and dispatched Tuesday the following week. This way we can guarantee the pershible products you ordered arrive to your address fresh and in a good conditions. You will be informed via email when the order is dispatched. In some cases your order might be dispatched on Wednesday.

We deliver any time during the hours of 9am to 5pm weekdays, excluding public holidays. In the event that the receiver is not home, the driver will follow the instructions provided during the checkout process. We can deliver to your home or place of work, or to the home or place of work of your relatives or friends. We always prefer to deliver your goods to a daytime delivery address - a location where there will be someone to collect it.

We do not ship via Australia Post.

We do not deliver to PO Boxes.

Delivery is organised via courier service. Some areas are excluded from the service provided by our courier. We retain the right to refuse delivery to anyone at all times. If a purchase is made and delivery is not a possibility, we will issue a full refund.

Delivery may take 0.5-7 working days. The duration of delivery will depend upon your choice of shipment method and destination. If you live within the Brisbane, Ipswich, Gold Coast, Sunshine Coast, Toowoomba or Beaudesert areas delivery should be made within 24 hours of the shipment but may also take longer.

Please note that delays may occur during transit due to weather conditions, product availability, national holidays, and other factors.

If you elected to have the driver leave the consignment in a safe spot, he will do so. If no instruction left then the driver will leave a card with a phone number. You will be requested to call the number on the card and request the order to be redelivered at a convenient time. Alternatively you may collect the consignment from a local depot (NOTE: this is not applicable to perishable goods!)

Perishable Items

"Perishable items" are goods that need to be chilled or require refrigeration and listed as such in the product description. They will require refrigeration as soon as they are delivered. If you requested the goods to be left with someone, you should advise them that they should refrigerate the items upon delivery. We will not be held responsible if the goods spoil. We make every effort to have your items delivered fresh to your door. All perishables are packed properly using insulating materials and dry ice to preserve freshness. The package will also be marked "Perishable".

When you place an order for perishable goods you are automatically providing us with the authority to leave the goods at the location specified by you during the checkout process. This means when your order includes at least one perishable item your parcel will be left at your door.

Delivery of perishable items is limited to certain destinations and determined by our courier. Please refer to a shipping calculator available at every product page to find out if we deliver perishables to your destination.

We might send perishable products on your request but we cannot be liable if goods spoil although we guarantee all arrangements will be made to preserve goods with proper packing. By placing an order and paying for perishable goods on www.ruskiwaydeli.com.au and requesting us to send it to the restricted areas you accept full responsibility for the goods in case they arrive spoiled.

The right to return does not apply to "perishable" items after they have been dispatched. That means you can not return any perishables purchased on our website back to us due to the complexity of handling pereshable goods. This is also due to the fact that perishables cannot be sent back to us properly packed to keep fresh.

 

Returns and Refunds

Orders may be cancelled by email at least 24 hours before your order is scheduled for the dispatch. Late cancelations may result with us inadvertently shipping your order. If such a situation occurs you will be held responsible for both the cost of goods ordered and shipment.

If your order has been dispatched you must return the goods to us at your expense before any refund is issued. The goods must be in a new and unopened condition. The products must be returned in the same or similar packaging. The goods are your responsibility until they are delivered to us. When we receive the products and determine that they are in good condition, we will then issue you a refund excluding the cost of shipment.

If goods returned have been damaged or become defective in some way a refund will not be issued or only partially issued. We will notify you of the situation and you may have the option of having the items sent back to you at your expense.

The right to return does not apply to "perishable" items after they have been dispatched. That means that you can not return any perishable goods purchased on our website. This is due to the fact that perishables cannot be sent back to us properly packed to keep fresh. Please refer to "Perishable Items" clause of this Terms and Conditions. 

In-store return option is always available - just return the goods to the store during open hours.

If you received a defective item, we will issue you with a shopping credit for the amount of that defective item. However, we cannot be responsible for the taste quality of the products. We do not accept any claims for change of mind either.

You must contact us within 12 hours after delivery of defective goods. We will make arrangements for our courier to pick up the defective goods at our expense. No claims are honoured after 12 hour period from receiving the goods. We determin the time of receiving goods as time recorded by our courier on its tracking page.

Depending on the filter you are using, you may be able to approve our e-mail address so that the correspondence from us arrive in your normal mailbox as designated. Complaints

If you have any complaints you should submit a new dispute via the resolution center at your account. You must provide your full details, order reference number as well as a reason for the complaint.

Promotional offers may be altered or removed at any time without prior notice. Since all offers displayed on our site are in fact offers to treat, individuals purchasing products on our website do not have the ability to accept, that right lies with us alone. Liability

The liability of Ruski Way Deli & Cafe whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the Product or any other breach of Ruski Way Deli & Cafe’s obligations hereunder shall not in any event exceed an amount equivalent to the price of the product.

Ruski Way Deli & Cafe shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever nor shall Ruski Way Deli & Cafe be liable for any damage or loss caused by the Customer’s servants, agents, buyers or other persons whatsoever.

 

Force Majeure

If the performance by Ruski Way Deli & Cafe of its obligations under current terms and conditions is prevented by reason of force majeure (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of any government or government agency, strikes, labor disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, delay in transit, electricity or communications failures, or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of Ruski Way Deli & Cafe) we shall be excused from such performance to the extent of such prevention.
